On January 6, 2020, the FMCSA enacted the Drug & Alcohol Clearinghouse regulation. This new mandate requires CDL employers to register their drivers into the online database, which keeps track of drug and alcohol violations. As an employer, this is important because the online database will allow you to make smarter hiring decisions and manage current drivers at your company. You’ll be able to meet pre-employment investigations and report any violations.

When does the FMCSA Drug and Alcohol Clearinghouse Regulation go into Effect?

The FMCSA Drug and Alcohol Clearinghouse went into effect on January 6, 2020.

Will Violations that Occur Before January 6, 2020 Need to be Included in the Clearinghouse?

No, the Clearinghouse database will only contain violations that occurred on or after the implementation date.

How do Driver Employers Meet Their Clearinghouse Obligations?

Ensure all your employees have been correctly entered into the database and report any drug and alcohol violations. This includes alcohol tests that result in a .04 or greater, refusals to take an alcohol or drug test, as well as actual knowledge of a violation.

In addition, employers will also report negative return-to-duty test results and the successful completion of a driver’s follow-up testing plan.

Lastly, employers are required to query all current employees at least annually. All queries require driver consent.
