The Federal Motor Carrier Safety Administration created the Drug & Alcohol Clearinghouse to help make the roads safer for all drivers. The purpose of the FMCSA Drug & Alcohol Clearinghouse is to identify commercial drivers with drug and alcohol program violations.

This new mandate from the Department of Transportation went into effect on January 6, 2020. If you hold a commercial driver’s license (CDL) or employ truck drivers, then you must make sure you are compliant with the specifications of the Clearinghouse.

What is the FMCSA Drug and Alcohol Clearinghouse?

The FMCSA Drug & Alcohol Clearinghouse is an online database that keeps a record of all commercial motor vehicle (CMV) drivers and flags those with federal drug and alcohol program violations. Having a centralized database that stores this type of information in real-time allows employers to prohibit unsafe drivers from performing safety-sensitive functions.

More specifically, FMCSA Drug and Alcohol Clearinghouse tracks CDL holders who have tested positive for prohibited drug or alcohol use or refused to take required drug tests. Additionally, the Drug and Alcohol Clearinghouse records when a driver completes the return-to-duty process and follow-up testing plan.

The Drug and Alcohol Clearinghouse regulation improves highway safety by making it:

  1. Easier for employers to meet pre-employment investigation and reporting obligations

  2. Challenging for drivers to conceal drug and alcohol violations from current and prospective employers

The Drug and Alcohol Clearinghouse affects all CDL drivers who operate CMVs on public roads as well as their employers and service agents.
